Transsexual Instructor: I Was Fired Because of Discrimination

The instructor sued the University of Rancagua, alleging that they canceled his contract because he is transsexual. He says, "I want them to own up to it."

It's been two years since Andrés Rivera decided to reveal to the world that despite having been born with a woman's body, he'd always felt like a man.  He lost friends and jobs.  With time he recovered emotionally, and in a coat and tie he succeeded in obtaining a position as an instructor in childhood education at Arturo Prat University (even with them being aware he was a transman), he participated in community projects in the municipality of Rancagua, and formed an organization to advocate for the rights of people like himself.

 

But just when everything seemed to be going well, a new problem arose that has him now having to seek justice in the courts.  "I applied to the University of Rancagua and I went to the interview, during which I told them about my situation.  At the beginning of March they told me that they had approved my contract and that in the summer they would give me my work schedule.  But it turned out that on the first day of work the new chief of staff told me that she didn't want me on her team.  They fired me for reasons of discrimination, and therefore I had to sue them," said the 42-year-old transsexual man.

 

Did you ever think about not telling them that you are a transman?

 

"No.  In struggling for the dignity of transsexual people, it's necessary to face these things head-on."

 

I asked you that because you look very much like a man.

 

"That's what I am.  When I came out, I had my breasts, uterus and ovaries removed, and for more than a year I've been using testosterone, which causes the growth of more body hair, made my waist disappear and made my voice deepen.

 

But legally you're still a woman, aren't you?

 

Yes.  I'm working with a lawyer now to present a civil petition for a change of name and sex.  I have problems with this all the time--at the bank, at the airport.  It's a mess and I always have to walk around carrying medical certificates of transsexualism.

 

When did you realize that you were different?

 

Since the beginning.  I was born in the wrong body.  This isn't something that one does along the way, or because one is abused as a child.  It just means that one's brain developed with a masculine identity.

 

What do you hope to accomplish with your lawsuit?

 

I want the subject of transsexualism to be put out on the table, and I want the University to admit its discriminatory action.

 

 

"I Asked Forgiveness"

 

The rector of the University of Rancagua, Claudio Urtubia, explained that the reasons for not hiring Andrés were purely technical.  "I met with him and begged his pardon if he felt discriminated against, and I offered him an arrangement to compensate for the time he spent developing the educational program he presented to us."

 

And you can vouch that there was no discrimination involved?

 

"Absolutely."

Profesor transexual: "Me dejaron sin trabajo por discriminación"

El docente demandó a la Universidad de Rancagua, aduciendo que no lo contrataron por su condición transexual.  "Quiero que lo reconozcan", dice.

Desde hace dos años que Andrés Rivera decidió mostrarle al mundo que pese a haber nacido en un cuerpo de mujer, se ha sentido siempre como un hombre.  Perdió amigos y trabajo.  Al tiempo, se recuperó emocionalmente y de corbata y camisa logró que incluso sabiendo su condición de transexual masculino lo contrataron como docente de Educación de Párvulos en la Universidad Arturo Prat, participar en proyectos comunitarios en la municipalidad de Rancagua y formó una organización para defender los derechos de las personas como él.

 

Per justo cuando todo parecía fluir, surgió un nuevo problemo que lo llevó a acudir a la justicia.  "Postulé a la Universidad de Rancagua, fui a la entrevista donde conté de mi condición, me dijeron que se había aprobado mi contratación a partir de marzo y en el verano me dieron el horario.  Pero resulta que el día de la presentación oficial de los docentes, la nueva jefa de carrera me dijo que no me quería en su equipo.  Me dejaron sin trabajo por discriminación y, por eso, los demandé", contó el transexual, de 42 años.

 

--¿Nunca pensaste en no decirles que eres transexual?

 

--No.  Para luchar por la dignidad de los transexuales hay que dar la cara siempre.

 

--Te lo digo porque te ves como un hombre.

 

--Es lo que soy.  Además, cuando me asumí me saqué las glándulas mamarias, me extirparon el útero, ovarios y trompas, y desde hace más de un año estoy con testosterona que hace que salga más vello, que desaparezca la cintura y se engrose la voz.

 

--Pero legalmente sigues siendo una mujer, ¿cierto?

 

Sí.  Trabajo con un abogado para presentar la demanda civil de cambio de sexo y nombre.  Todo el tiempo tengo problemas con eso, en el banco, en el aeropuerto.  Es un lío y siempre tengo que andar con mis certificados médicos de transexualidad.

 

--¿Cuándo te diste cuenta de que eras diferente?

 

--Desde siempre.  Yo nací en un cuerpo equivocado.  No es que uno se haga en el camino o que te violaron cuando niño.  Significa que tu cerebro se formó con identidad masculino.

 

--¿Qué pretendes con la demanda?

 

--Que la temática transexual se ponga en la mesa y que la universidad reconozca públicamente su acto de discriminación.

 

 

"Le pedí disculpas"

 

El rector de la Universidad de Rancagua, Claudio Urtubia, explicó que las razones de la no contratación de Andrés fueron exclusivamente técnicas.  "Yo me reuní con él, le pedí disculpas si se sintió discriminado y le ofrecí un acuerdo por el tiempo que ocupó en realizar el proyecto de programa educativo que presentó", detalló.

 

--¿Puede asegurar que no hubo discriminación?

 

--Absolutamente.

 

 


 

 

 

 


 

TRANSEXUAL CHILENO, OBTIENE SENTENCIA DE CAMBIO DE NOMBRE Y SEXO

 

Aunque hace ya un par de años, Maria Georgina Rivera Duarte, asumió su Transexualidad y decidió vivir de acuerdo a lo que sentía desde niño, ser en realidad  Andrés Ignacio Rivera Duarte, le faltaba un tramite legal, su reconocimiento como Hombre  en su Cedula de Identidad.

 

Andrés Rivera, hace ya 4 años se sometió a una operación de Mastectomía, (extirpación de glándulas mamarias), hace dos años de Histerectomía ( extirpación de útero y ovario) y dos años 3 meses con tratamiento hormonal.

 

Activista, Presidente y Fundador de la Organización de Transexuales por la Dignidad de la Diversidad de Chile,  que ha sufrido en carne propia la discriminación, perdiendo su trabajo, estando cesante por dos años, sabiendo lo que es el dolor de estomago de hambre y el dolor de huesos por el  frío. Discriminados por quienes se decían sus amigos, colegas y familia. Un luchador incansable, enigmático, de sonrisa amplia, con una mirada profunda que muchas veces intimida, calmado en su hablar, pero absolutamente enérgico y seguro.  Presentó hace algunos meses una Demanda Civil de  “Cambio de Nombre y Sexo”, en un Tribunal Civil, en la Comuna de Rancagua, Chile.

 

Después de exámenes médicos, evaluaciones psiquíatricas y psicológicas, evaluaciones en el Instituto Medico Legal, hoy 4 de Mayo del 2007 OBTIENE SU SENTENCIA JUDICIAL, de CAMBIO DE NOMBRE Y SEXO, pasando a ser a contar de hoy legalmente ANDRES IGNACIO RIVERA DUARTE, SEXO MASCULINO.

 

Andrés Rivera ha sentado un precedente en la Legislación Chilena, Andrés es un Hombre-Trans sin pene, no se ha operado y según sus propias palabras “No necesito un pene para ser un hombre”, este hombre ha logrado que una Magistrado vea mas allá de los cuadrado y excluyente de la Ley, que dice que “si tiene pene es hombre y que si tiene vagina es mujer”, ha logrado el reconocimiento a su Transexualidad, Andrés con su forma de ser, su tenacidad, su lucha, su activismo, su compromiso con los y las transexuales, ha demostrado que se pueden conquistar espacios y alcanzar igualdades y respeto al ser humano, mas allá de su condición u opción sexual.   

 

Andrés, podrá dentro de un plazo de 10 días obtener su Cedula de identidad nueva, y seguir su lucha, porque como dijo hoy al salir de Tribunales “Hoy nazco legalmente, la lucha no termina acá, está recién empezando”.

 

Se han abierto las esperanzas para los y las transexuales, que no se pueden operar, por motivos económicos o de salud, se abre un camino cierto de igualdades, justicia y dignificación.

CHILEAN TRANSSEXUAL OBTAINS DECREE OF CHANGE OF NAME AND SEX.
 

Although it’s already been several years since Maria Georgina Rivera Duarte revealed his Transsexuality and decided to live the way he has felt since he was a child, to in reality be Andrés Ignacio Rivera Duarte, he still lacked legal recognition as a man on his identification documents. 

 

Four years ago Andrés Rivera underwent mastectomy surgery (removal of mammary glands), two years ago underwent a hysterectomy (removal of the uterus and ovaries) and has been taking male hormones for two years and three months. 

 

Andrés is an activist (President and Founder of the Organization of Transsexuals for the Dignity of the Diversity of Chile) who has directly suffered discrimination, losing his job and being unemployed for two years, experiencing the pains hunger and cold.  He felt the rejection of those who claimed they were his friends, colleagues and family.  A tireless fighter, enigmatic, with a broad smile and a deep look that many times intimidates, a calm speaker, but absolutely powerful and sure of himself.  A few months ago he brought a civil court suit for a "Change of Name and Sex" in the community of Rancagua, Chile. 

 

After medical exams and psychiatric and psychological evaluation by the Medico-Legal Institute, today, the 4th of May, 2007 HE OBTAINS HIS JUDICIAL DECREE of CHANGE OF NAME AND SEX, henceforth being legally ANDRÉS IGNACIO RIVERA DUARTE, MALE SEX.  Andrés Rivera has set a legal precedent in Chile: Andrés is a transman without a penis, not having had phalloplasty surgery, and who in his own words says, "I do not need a penis to be a man.”  This man has convinced a judge to see beyond the narrow exclusionary words of the law that say "if one has penis he is a man, and if one has a vagina she is a woman," and thus has achieved recognition of his transsexuality. Andrés, with his individuality, his tenacity, his struggles, his activism, his commitment to the transsexual community, has shown that spaces can be conquered and equality and respect for human beings can be attained, regardless of one’s sexual condition or choices. 

 

Within ten days Andrés will be able to obtain his new identity documents and continue his activism, because as he said today when leaving the court, "Today I may be born legally, but the fight does not finish here, it is just beginning." 

 

Hope now exists for all transsexuals who cannot have surgery for economic or health reasons, that a path has been opened toward equality, justice and dignity.

Han sido días intensos, de mucho trabajo,  reuniones y emociones, La agenda de trabajo es agotadora, con 4 a 5 reuniones diarias, insertas en redes con Embajadores, Ministros, Cancilleres, Comisionados y Delegaciones de los diferentes Países. Sin duda es una experiencia que no olvidare, ya les contare detalles a mi regreso.
